Spark Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of Spark, including the Spark mobile application, related websites, notifications, support channels, and related services.

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use Spark.

Who We Are

Spark is owned and operated by Aadil Rifath, an individual based in Sri Lanka (“Spark,” “we,” “our,” or “us”). Spark is operated in association with participating university programme partners, which act as challenge organizers and eligibility authorities but do not own or operate the Service.

Eligibility

  • you are at least 18 years old
  • you have the legal capacity to agree to these Terms
  • the information you provide to Spark is accurate and current

Your Account

  • maintaining the confidentiality of your credentials
  • all activity that occurs under your account
  • keeping your account information accurate and up to date

Acceptable Use

Spark is intended for lawful participation in challenges, workspaces, teams, reviews, and related collaboration or administration workflows made available through the Service. Spark does not offer paid features, subscriptions, or user-to-user messaging at launch; if these are introduced, these Terms will be updated first.

Prohibited Conduct

  • unlawful, fraudulent, deceptive, or unauthorized use
  • harassment, threats, abuse, discrimination, or impersonation
  • unauthorized access to accounts, systems, files, or data
  • malware, spam, or abusive automation
  • uploads you do not have the right to use or share
  • bypassing role, permission, invite, or verification controls

Competition Integrity and Fair Participation

  • no submitting work that is not your own where originality is required
  • no impersonation or misrepresentation of authorship, affiliation, or eligibility
  • no unauthorized assistance or automation where rules prohibit it
  • no interference with challenge operations, rankings, judging, or review integrity

User Content and Submissions

You retain ownership of content you own. However, you grant Spark a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt, display, transmit, review, moderate, and otherwise use that content as needed to operate, secure, improve, and enforce the Service.

Teams, Workspaces, Invites, and Role-Based Access

Spark includes collaborative and role-based features. Invitation, membership, and role assignments may affect what information or content you can access.

Verification, Review, and Organizer Decisions

Spark may offer verification, eligibility, approval, review, or similar access-control workflows. Organizers, institutions, employers, or workspace administrators may review submissions, results, eligibility, and related materials and may make decisions within their use of the service.

Rankings, Profiles, and Visibility

Spark may display participant names, usernames, profiles, results, rankings, statuses, or related content within challenges, workspaces, teams, leaderboards, or other service surfaces where those features exist.

Privacy

Our collection, use, and disclosure of personal information are described in Spark’s Privacy Policy.

Third-Party Services and Open Source

Spark may use third-party services, SDKs, infrastructure providers, and open-source software components.

Intellectual Property

Spark and its licensors retain all rights, title, and interest in and to the Service, including the app, software, branding, design, and content owned by Spark.

Availability and Changes

We may modify, suspend, discontinue, or limit any part of Spark at any time, with or without notice, subject to applicable law.

Suspension and Termination

Spark may suspend, restrict, or terminate your access for violations, abuse, fraud, unauthorized access, or other legal, security, or safety risks.

Content Moderation and Takedowns

Spark may monitor, review, restrict, block, remove, or preserve content, submissions, files, feedback, or other materials where necessary to enforce these Terms, protect the service, or comply with legal obligations.

Disclaimers

To the maximum extent permitted by law, Spark is provided on an “as is” and “as available” basis.

Limitation of Liability

To the maximum extent permitted by law, Spark and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.

Governing Law and Disputes

These Terms will be governed by the laws of Sri Lanka, without regard to conflict-of-law principles, except where local consumer law requires otherwise.

If a dispute arises, you agree to first contact us and attempt to resolve it informally through good-faith negotiation. If the dispute is not resolved informally within a reasonable time, it will be subject to the exclusive jurisdiction of the courts of Sri Lanka.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may provide notice through the Service, the website, or other reasonable means.
